Ensuring Fair Compensation for Our Colorado Clients

The Federal Labor Standards Act outlines the requirements that employers must meet regarding wages and hours. In addition, states have passed their own labor laws and related orders, such as the Colorado Overtime and Minimum Pay Standards order (COMPS or Order #37), which protects the pay rightfully due to hardworking Coloradans.

Everyone deserves to be treated appropriately at work, just as everyone deserves the compensation they have earned. If you are involved in a dispute regarding wages or work hours with your employer, the Denver wage and hour law attorneys at Colorado Employee Advocates can assist you. We are prepared to work tirelessly to ensure that your rights are protected.

Understanding Wage & Hour Laws in Colorado

In Colorado, employers must pay workers at least the current minimum wage of $12.32 per hour and time and a half overtime pay when employees work more than 40 hours per week or 12 hours per workday. Tipped employees must be paid a minimum of $9.30 per hour.

The Colorado Wage Act (C.R.S. § 8-4-101)—which addresses factors such as bonuses, commissions, deductions from wages, pay periods, and pay statements—requires Colorado employers to pay workers their earned wages in a timely manner.

The Equal Pay for Equal Work Act, most recently updated in January of 2021, requires employers to include compensation for all positions in job postings. It also requires that they notify all employees of promotional opportunities as well as keep job description and wage rate records on file.

Labor laws are nuanced and can be extremely confusing. If you are unsure whether your employer is complying with state or federal labor laws, it can be helpful to consult with an attorney. At Colorado Employee Advocates, we can assess your situation and determine whether your rights are being violated.

Head to the Colorado Department of Labor and Employment website to learn more about wage and hour laws as well as how to report complaints. Additionally, we recommend consulting with a wage and hour lawyer near you to discuss your legal options and determine whether you have a viable case.
